On May 28, 2026, the National Assembly passed, on first reading, a bill to repeal the “Code Noir,” that is, “the King’s Edict on Slaves in the Islands of the Americas of March 1685, as well as all provisions of any kind adopted for its application, adaptation, or extension to other territories.” This bill reveals that the “Code Noir” occupies a unique place in the memory of the slave trade and slavery in 16th–19th-century France, with no equivalent in similar legal texts from the former Spanish, Portuguese, British, or Dutch empires.
This lecture will focus on the origins of the 1685 edict, its implementation, its uses, and the debates it sparked from 1685 to 1848; what the term “Code Noir” has come to encompass; and the reasons for its centrality in the memory of slavery in France.
